Benian Technologies provides AI consulting, automation, and deployment services including but not limited to:

• AI workflow automation design and implementation
• AI front desk and voice agent solutions
• Data intelligence and analytics platforms
• Custom AI solution development
• AI audit and readiness assessments
• Enterprise chatbot and orchestration platforms

We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice. Specific service engagements may be governed by separate statements of work or service agreements.

When you create an account or engage our services, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access

All content, software, designs, logos, trademarks, and other materials on our website and platform are the property of Benian Technologies or its licensors and are protected by intellectual property laws.

Your Content: You retain ownership of any data, content, or materials you provide to us. By providing content, you grant us a limited license to use it solely for the purpose of delivering our services.

Custom Solutions: Unless otherwise agreed in writing, custom AI solutions, models, and configurations developed for you during a service engagement are owned by you upon full payment. Underlying frameworks, libraries, and pre-existing tools remain our property.

To the maximum extent permitted by law, Benian Technologies and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim related to our services shall not exceed the amount paid by you to us in the twelve (12) months preceding the event giving rise to the claim.

AI-generated outputs are provided on an "as-is" basis. While we strive for accuracy and reliability, we do not guarantee that AI outputs will be error-free or suitable for any specific purpose without human review.

You agree to indemnify and hold harmless Benian Technologies, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from:

• Your use of our services
• Your violation of these Terms
• Your violation of any third-party rights
• Any content or data you provide through our services

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles.

Any dispute arising from these Terms or your use of our services shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, it shall be submitted to binding arbitration in Austin, Texas under the rules of the American Arbitration Association.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action or representative proceeding.

We may update these Terms of Service from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you via email or a prominent notice on our website.

Your continued use of our services after any changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must discontinue use of our services.
